75-100% Disability

• Benefits: Receives 100%  as the disability element. For 100% disability, the disability element is 30% of reckonable emoluments last drawn. For lesser percentages of disability, the amount is reduced proportionally, and no disability element is payable for disability assessed as less than 20%.

Calculation of Disability Pension 

For example, if your total Pay is Rs. 60,000/- including Basic Pay, MSP, and Class Pay. Now, let’s assume your percentage of disability is 80%, in this case, you will get 100% of the disability component. For 100% disability, the disability element is 30% of reckonable emoluments last drawn, i.e 

The total disability pension, you will receive is Rs. 27,000/- 

50-75% Disability

If your disability percentage lies in 50-75%, then you will receive 75% of the basic pay as the disability element. For example, if your disability percent is 60%, then the mathematical calculation for the disability pension, in this case, is given as:

20-50% Disability

If your disability percentage lies in 20-50%, then you will receive 50% of the basic pay as the disability element. For example, disability percent is 45%, then the total disability pension in this case is given as:

Is Disability Pension Taxable or not?

• For Armed Forces Personnel: Disability pension received by armed forces personnel is exempt from income tax under Section 10(14) of the Income Tax Act, 196.
• For Civilians: Disability pension received by civilians is generally taxable. However, they can claim deductions under Section 80U of the Income Tax Act if the disability is severe. This section allows for a deduction of up to ?1,25,000 depending on the severity of the disability.
